Since MvsC2, the trouble they had was licensing between the two companies with each individual character, also considering Capcom = Japanese and Marvel = America.

Actually its a pretty good chance! There's a rumor that it will come out bc it's not only been pressured by fans for the game, but a person part of the Marvel staff even admitted there is a game on the making of marvel vs. capcom....... read this

No. All video game rights to Marvel (outside fo the ones based on Holywood movies) are owned by Activision and EA.
